Intellectual Property

All content, designs, graphics, logos, and materials created by Heiga Creative remain our intellectual property unless specifically transferred to the client through a written agreement.

 

Your Intellectual Property

Any materials you provide to us remain your property. You grant us a limited license to use these materials for the purpose of providing our services to you.

 

Delivered Work

Upon full payment, you will receive rights to the final deliverables as specified in your service agreement. Unless otherwise stated, Heiga Creative retains the right to display completed work in our portfolio.

 

Confidentiality

We respect your privacy and confidentiality. Information shared with Heiga Creative for business purposes will be treated confidentially and will not be disclosed to third parties without consent, except when required by law or when necessary to fulfill our services.

 

Payment Terms

Fees

Our fees will be clearly communicated before services commence. Any additional costs will be discussed and approved before being incurred.

 

Payment Schedule

Unless otherwise stated, a 50% deposit is required before work begins, with the remaining balance due upon completion of services or as outlined in your service agreement.

 

Late Payments

Invoices not paid within 15 days of the due date may incur a late fee of 1.5% per month on the outstanding balance.

 

Cancellation Policy

If you cancel a project after work has begun, you will be billed for all work completed up to the cancellation date plus 25% of the remaining project fee.

 

By Heiga Creative

We reserve the right to terminate services if you breach these Terms or if we are unable to deliver services due to circumstances beyond our control.

 

Limitation of Liability

Heiga Creative is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you for the services in question.

 

Indemnification

You agree to indemnify and hold harmless Heiga Creative from any claims, damages, liabilities, costs, or expenses arising from your use of our services or your violation of these Terms.

 

Modifications to Terms

Heiga Creative reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after any changes indicates your acceptance of the new Terms.

 

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law provisions.
